How do I request my medical records?

Case 1 – If you are the patientExpand
Hand-signed letter of request, specifying: Which part of the medical record is required? What is the purpose of the request? To which email address should the medical record be sent? Identification document, both sides.
Case 2 – If the patient is a minorExpand
A handwritten letter of request, signed by the mother, father, or guardian, indicating: Which part of the medical record is required? What is the purpose of the request? To which email address should the medical record be sent? Identification document of the minor and the applicant, both sides. Document certifying the relationship: Parents: Birth certificate. Guardian: Proof of legal representation or custody of the minor.
Case 3 – If you are not the patient (Authorized third party)Expand
A handwritten letter of request, signed by the patient, authorizing a third party to claim their medical record, specifying: Which part of the medical record is required? What is the purpose of the request? To which email address should the medical record be sent? Identification document of the patient and the authorized third party, both sides.
Case 4 – If the patient is deceasedExpand
The request can only be made by parents, siblings, children, spouse, or common-law partner. A handwritten letter of request, signed by the applicant, must be submitted, indicating: Which part of the medical record is required? What is the purpose of the request? To which email address should the medical record be sent? A copy of the applicant's identification document (both sides) is required. A document certifying the relationship is also required: Parents, siblings, or children: Birth certificate. Spouse: Marriage certificate. Common-law partner: Declaration of common-law marriage with a conciliation agreement or public deed (issued during the deceased's lifetime), or a court order declaring the common-law marriage with the deceased.
Case 5 – If the patient is not in a condition to authorizeExpand
The request can only be made by parents, siblings, children, spouse, or common-law partner. A handwritten letter of request, signed by the requester, must specify: Which part of the medical record is required? What is the purpose of the request? To which email address should the medical record be sent? Identification documents for both the patient and the requester (both sides). Documentation certifying the relationship: Parents, siblings, or children: Birth certificate. Spouse: Marriage certificate. Common-law partner: Declaration of common-law marriage with a conciliation agreement, public deed, or court order. Medical certificate attesting to the patient's state of health, if the patient is being treated at a different institution. Fundación Valle del Lili.

Normativity

 In Colombia, medical records are private documents, subject to confidentiality and protected by law. They can only be accessed by third parties with the patient's authorization or in the cases stipulated by law.

 

 

  • Resolution 1995 of 1999, Art. 1: regulates the confidentiality of medical records.
  • Law 23 of 1981, Art. 34Medical ethics law.
  • Constitutional Court Ruling T-182/09: specifically for deceased patients or those who are unable to authorize their relatives.
